This Privacy Policy explains the privacy practices of Fluid Motion LLC d//b/a Solara Boats (“Solara Boats”, “we”, “us”, “our”) when you access our websites, www.solaraboats.com and www.tugnuts.com (each a “Website”, together the “Websites”) or use the services provided thereon (together with the website, the “Services”). This Privacy Policy describes how we collect, use, and share personal information about you when you use our Services, and your rights and choices in connection with this. Collection and Use of Your Personal Information

 

In order to better provide you with products and services offered on our Site, Solara Boats and its affiliates may collect personal information, which is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you. This may include, but is not limited to, your: name, postal address, telephone number, email address, browser and device information (including IP Address), and information collected through cookies and other similar technologies.

Contact us through the Services.  If you fill out the Contact Webform on the Website, we collect from you your personal identifiers (such as your first and last name, email address, mailing address, phone number), commercial information about you (such as whether you are interested in a particular Solara Boats model and where you found us), and any other personal information you choose to include in your message. We use this information to respond to your query.

 

Contact us by phone or email. When you contact us or send us any feedback, comments, or suggestions, we collect from you any personal information you choose to include in such communication, as well as personal identifiers (such as your phone number if you contact us by phone or your email address if you contact us by email). We use this information to respond to your queries. With your consent, we may also use this information to publish your testimonials or featured customer stories on our Services.

 

Request an estimate.  When you use the Build A Boat tool and wish to contact us to request an estimate related to your boat, we collect from you your personal identifiers (such as first and last name, email address, address), and commercial information about you (such as the selection you made in the Build A Boat tool). We use this information to provide you with an estimate regarding your customized boat.

 

Sign up for our newsletter and/or event notifications. When you sign up for our newsletter, we collect from you your personal identifiers (such as your name and email address). We use this information to send you email copies of our quarterly newsletter, The Factory Bulletin, and/or send you email updates about upcoming events, at your selection. You may unsubscribe at any time from our newsletter or event notifications by clicking the unsubscribe button at the bottom of the particular email.

 

Attend an As the Prop Turns live webinar.  We use Zoom to provide our As the Prop Turns live webinars. When you attend a webinar, we collect from you your personal identifiers (such as your first name, last name, and email address). We use this information to facilitate the webinar and improve our webinars in the future.

 

Apply for Employment. To apply for employment with us, we collect from you: your personal identifiers (such as your first and last name, address, email address), and any personal information as may appear on your resume such as your professional information, education information, and inferences made from the foregoing. We may also collect from you the personal identifiers (such as the first and last name, phone number, and email address) of references you provide. We use this information to respond to your application for employment.

 

Register for Tugnuts.  If you register to become a Tugnuts member, we collect from you your personal identifiers (such as your username, email address, password, first and last name, address, phone number, and your MMSI Number). We use this information to facilitate the Tugnuts forums and provide you with access to the requested Services.

Advertising cookies.  Our advertising providers use cookies and web pixels to identify and store behaviors that users take when visiting our Websites (such as pages visited and search terms used). These cookies are used in order to: (i) identify you as a prospect for our Services; (ii) deliver advertisements that are more relevant to you and your interests; (iii) limit the number of times you see an advertisement; as well as (iv) help measure the effectiveness of the advertising campaign. If a user engages with our content, their behavior on our Websites is used to present them with targeted advertising based on their interests.   • We use Google Ads and AdRoll (NextRoll) to serve you ads based on your browsing behavior.   • We use Facebook Pixel to customize our advertising and to serve you ads on your social media based on your browsing behavior. This allows your behavior to be tracked after you have been redirected to our website by clicking on the Facebook ad. The Facebook Pixel stores a cookie on your computer to enable us to measure the effectiveness of Facebook ads for statistical and market research purposes. We do not have access to the personal information collected through the Facebook Pixel. However, the information collected via the Facebook Pixel, on our Website as well as other websites on which Facebook Pixel is installed, is also stored and processed by Facebook. Facebook may link this information to your Facebook account and also use it for its own promotional purposes in accordance with Facebook's Data Usage Policy. We collect personal information about you from third parties when you:

 

Sign up for the Pacific Northwest Factory Delivery Experience.  If you choose to purchase your Solara Boat for pickup directly from our factory, we collect from the Solara Boat authorized retailer your personal identifiers (such as your first name, last name, email address, phone number, and mailing address) and your commercial information (such as the Solara Boat model you purchased, any customizations to the Solara Boat, and your payment details). We use this information to facilitate your factory delivery, Solara Boat Destination Cruise, and, if requested, to ship your new boat to your desired location after your cruise.

 

Make a purchase from one of our authorized retailers: If you choose to purchase your Solara Boat from one of our authorized retailers, we collect from the Solara Boat authorized retailer your personal identifiers (such as your first name, last name, email address, phone number, and mailing address) and your commercial information (such as the Solara model you purchased, any customizations to the Solara Boat, and your payment details). We use this information to facilitate your purchase, and, if you choose, to sign you up for the Pacific Northwest Factory Delivery Experience.

 

Sharing Information with Third Parties

 

Solara Boats does not sell, rent, or lease personal information to third parties.

 

Solara Boats will share your personal information for the purposes set forth below:

 

Service providers. We share personal information with our service providers, such as email providers, web conference providers, and analytics providers. We limit the information shared with our service providers to what is necessary to fulfill the services. We use the following providers for advertising, analytics and online webinars:

 

Analytics provider.  We use Google Analytics to collect information on your use of the Website to improve our Website. You may view Google Analytics Terms of Service and the Google Privacy Policy for information about how Google uses the information provided to Google Analytics and how you can control the information provided to Google. You can exercise your right to opt-out of ad personalization by using any of the methods set forth here or using the Google Analytics opt-out browser add-on here.

 

Digital advertising and analytics partner. We partner with Rollick Inc. to advertise on digital platforms and collect information on your use of the Website. You may view the Rollick Terms of Service and Rollick Privacy Policy for information about how Rollick uses the information provided to Rollick and how you can control the information provided to Rollick.

Web conference provider.  We use Zoom to provide our online webinars.

 

           

Within Solara Boats.  We share personal information within our corporate family, such as with subsidiaries, joint ventures, or affiliates, in order to efficiently carry out our business and to the extent permitted by law.

 

Corporate reorganization.  In the event that we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our business, assets or stock, we would share personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. We would also share personal information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings.

Your Choices with Respect to Your Information  

 

Update Tugnuts Member Information.  You can update your account information (including your website, occupation, interests, mailing list preferences, first name, last name, mailing address, phone number,Solara model, HIN, non- Solara boat model, vessel name, and MMSI Number) at any time by logging in to your member account on the Tugnuts Website.

 

Online Advertising.  To opt out of interest based advertising generally or to learn more about the use of this information you can visit the Network Advertising Initiative or the Digital Advertising Alliance. You can also visit the privacy settings of your Android or iOS device and select “limit ad tracking” (Apple iOS) or “opt-out of interest-based ads” (Android).

 

Google Analytics.  You can control the information provided to Google and opt out of certain uses of your information by using one of the methods set forth here. You can also download the Google Analytics opt-out browser add-on for Google Analytics, which can be found here.

 

Google Ads.  We utilize Google to serve ads that appear on Google products and on sites across the Internet.  To opt out of targeted advertising by Google, you can go to Google’s ad settings. You may also install the DoubleClick opt-out add-on. Once installed, even if you clear all your cookies and restart your browser, it will prevent the DoubleClick cookie from being saved to your browser. Google may also display other advertisements across the internet to you about third party services using the Google AdSense network, although this is beyond our control. Facebook Pixel. Promotional Emails.  You may opt out of receiving marketing emails from us by clicking the “unsubscribe” link provided with each email. If you unsubscribe from promotional emails, will continue to send you notifications necessary to the Website, the services, and your purchases.
